This paper links these ideas by suggesting that (i) empathy and morality are by-products of the expansión of brain's neocortex, and that (ii) the function of such capacities is to facilitate cooperation between individuals, increasing their social cohesion. The field of management has had difficulty embracing the concept of Machiavellianism despite the myriad of studies produced by other fields of social science. It appears that Machiavellianism as a unitary personality construct has limited efficacy in the complex world of organizations. The authors suggest a multidimensional approach to understanding the impact of an individual's threat to organizational functioning. Viewing the construct as discontinuous with two manifestations, predatory and benign, suggestions are made as to the location within organizations where such (...) individuals may be found. Alexander Miller has recently considered an ingenious extension of Frank Jackson and Philip Pettit's account of 'program explanation' as a way of defending non-reductive naturalist versions of moral realism against Harman's explanatory criticism. Despite the ingenuity of this extension, Miller concludes that program explanation cannot help such moral realists in their attempt to defend moral properties. Specifically, he argues that such moral program explanations are dispensable from an epistemically unlimited point of view. I show that Miller's argument for this negative (...) claim is inadequate, and that he has, in spite of himself, identified a promising defence of moral realism. (shrink)

Abstract“Suffering” is a central concept within bioethics and often a crucial consideration in medical decision making. As used in practice, however, the concept risks being uninformative, ambiguous, or even misleading. In this paper, we consider a series of cases in which “suffering” is invoked and analyze them in light of prominent theories of suffering. We then outline ethical hazards that arise as a result of imprecise usage of the concept and offer practical recommendations for avoiding them. INTRODUCTION BY NANCY FUMERO What is a translation that stalls comprehension? That, when read, parsed, obfuscates comprehension through any language – English, Portuguese. It is inevitable that readers expect fidelity from translations. That language mirror with a sort of precision that enables the reader to become of another location, condition, to grasp in English in a similar vein as readers of Portuguese might from João Guimarães Rosa’s GRANDE SERTÃO: VEREDAS. There is the expectation that translations enable mobility. That what was (...) written in one language be accessible in another. And that a translator is to serve as a mediator, acting ultimately in service to ideas within the source text. To disperse them. However, this notion of translation is partly antithetical to the ideas in Rosa’s work. Or, alternately, to convey the despair of terrain slipping beneath one’s feet, and to encounter the heightened suspense of magic, the translation, as part of its strategy, cannot devotedly rely on its original language, not as its source text. The work undertaken by Felipe W.Martinez is a new form of translation that risks everything in order to encounter the same treacherous knowing Rosa had traversed. And it takes its risks by not taking risks: by being, almost word for word, a literal translation. This is an approach that reductively converts, as opposed to translates. The idiomatic differences between English and Portuguese are not accented. The syntax is not finessed. Liberties are not assumed on account of improving readability. What stands, resoundingly amid such absences, is the awakened challenge of reading. The genuine peril of not knowing. That is, this translation, one that purports to know nothing, creates access into the guileful world Rosa had created in Portuguese. But not by translating. If anything, GRANDE SERTÃO: VEREDAS is speaking a cosmic language through a linguistic one. And W.Martinez does us the service of recognizing this, as what configures the shapes of words and sentences is not as simple as neologisms, portmanteaus, and digressions, but as terrifying as the path the fool traverses: all paths. As such, this translation doesn’t speak English, just as the original does not speak Portuguese. It is the assemblage of paradox as a new logic that can be navigated, if only one could suspend the comfort of readability, of expectation. If one could descend a mountain in the pitch dark of night, each step shocking the body, unable to acclimate to the unleveled heights. Without a doubt, the translation is incongruous to the Portuguese. Taking a small excerpt to compare: Eh, well, thereafter, the rest the Sir provide: comes the bread, comes the hand, comes the god, comes the dog. What is striking is the interplay between “god” and “dog”. To most English speakers, this anagram is a familiar one. But in Portuguese the words god (“deus”) and dog (“cão”) are not so closely linked. In fact, there is no direct mention of “deus” in Rosa’s text: Eh, pois, empós, o resto o senhor prove: vem o pão, vem a mão, vem o são, vem o cão. Both are fascinating. In Rosa’s excerpt, the rhythm is unmistakable and precise, despite, of course, the indices of hesitation: the commas, the Eh, the uncomfortable way of searching through prolongation and wait. This is the sort of paradox Rosa can engage within a sentence. W.Martinez’s does this as well, at a scale that reverberates beyond the sentence, and with one noticeable addition: deus. What may appear to be an overstep, to add such a weighted word that draws out wordplay but is, nevertheless, not in the source text, is exemplary of risk. The translation buzzes because of it. This is because throughout the text we encounter dogs frequently, as some primal beast on par with humans. The dog is one that masters and can be mastered. A creature that is at times its face, and at others a mask. It is a powerful presence. For the translator to be attuned to the reverent undercurrent attributed to this animal, and create within the translation such charged play in English from what was only an implication in Portuguese, is in tribute to the grand beauty within dissonance. What aberrant modes of writing and translation can teach us most assuredly, is that things, words, are not in states of rightness or wrongness, but of oscillation. This isn’t so different from what Rosa says himself: The Sir look…see: the most important and beautiful, of the world, is this: that the people are not always same, still were not completed — but that they go always shifting. The significance of private standards and associated local level initiatives in agri-food value chains are increasingly recognised. However whilst issues related to compliance and impact at the smallholder or worker level have frequently been analysed, the governance implications in terms of how private standards affect national level institutions, public, private and non-governmental, have had less attention. This article applies an extended value chain framework for critical analysis of Private Standards Initiatives (PSIs) in agrifood chains, drawing on primary research on PSIs (...) operating in Kenyan horticulture (Horticulture Ethical Business Initiative and KenyaGAP). The paper explores the legislative, executive and judicial aspects of governance in these southern PSIs highlighting how different stakeholders shape debates and act with agency. It is argued that governance is exercised ‘beyond the vertical’ in that one can identify wider horizontal processes of governance, including how the scope of key debates is constructed (especially in legislative governance) but analysis of executive governance emphasises the dominant role of the lead buyers. In this paper, we introduce a dialogue between (post-)phenomenological and decolonial approaches to propose a sentipensante ethics. Emancipating from hegemonic approaches to ethics that privilege rationality over feeling bodies, we conceptualise an analogical ethics of virtues that emerge in the framework of an analectic-responsive experience. In this experience, we specify the affective, interoceptive, and inter-bodily aspects as elements of a sentipensante ethics from an enactivist perspective. This exercise allows us to highlight the foundation of the ethical experience as a participatory (...) virtue-making oriented towards solidary well-being. Finally, it invites us to search for pedagogical practices that cultivate this virtue-making. En este artículo introducimos un diálogo entre enfoques (post-)fenomenológicos y decoloniales para proponer una ética sentipensante. Nos emancipamos de perspectivas hegemónicas que privilegian la racionalidad sobre los cuerpos que sienten, y conceptualizamos una ética analógica de virtudes que emergen en el marco de una experiencia responsiva analéctica. De esta experiencia, precisamos los aspectos afectivos, interoceptivos, e inter-corporales, como elementos de una ética sentipensante desde una perspectiva enactivista. Este ejercicio nos permite resaltar el fundamento de la experiencia ética como un hacer-virtud participativo orientado hacia el bienestar solidario. Finalmente, nos invita a buscar prácticas pedagógicas que cultiven este hacer-virtud. (shrink)

In this paper, we describe the use of legal ontologies as a basis to improve IT support for professional judges. As opposed to most legal ontologies designed so far, which are mostly based on dogmatic and normative knowledge, we emphasize the importance of professional knowledge and experience as an important pillar for constructing the ontology. We describe an intelligent FAQ system for junior judges that intensively use the ontology.

Kant informs us that the categorical imperative is a synthetic a priori proposition. It might be thought that Kant means thereby to say that we have an a priori rational insight, somewhat like that which Plato claimed for the Forms, into this basic moral truth. W. D. Ross had a similar view about human rational insight into certain basic moral principles, and in his book Kant's Ethical Theory he attritubes such a view to Kant.I argue that this initially plausible interpretation (...) is not correct, and that the "rational intuitionism" that it involves goes against Kant's whole approach to philosophy, in the first Critique as well as in the moral philosophy. I develop a new alternative interpretation, as follows: the categorical imperative is synthetic because it contains a claim about the causal/motivational power we have to act purely from the motive of duty, without any assistance from "sensible" or empirical motives, such as pleasure or pain. This claim, qua motivational, goes beyond the meaning of the categorical imperative considered as a mere ethical precept. It is a priori because this motive's source is the noumenal self.Hence to justify the categorical imperative is to show that this sort of non-sensible motive is or could be active in us as agents, and Kant is an "internalist": one who believes that morality and motivation are internally, analytically connected. Nach Kant ist der kategorische Imperativ ein synthetischer Satz a priori. I outline a pragmatic account of evidence, arguing that it allows us to underwrite two implications of feminist scholarship: that knowledge is socially constructed and constrained by evidence, and that social relations, including gender, race, and class, are epistemologically significant. What makes the account promising is that it abandons any pretense of a view from nowhere, the view of evidence as something only individuals gather or have, and the view that individual theories face experience in isolation.

The report of the President's Council on Bioethics, Human Cloning and Human Dignity, addresses the central ethical, political, and policy issue in human embryonic stem cell research: the moral status of extracorporeal human embryos. The Council members were in sharp disagreement on this issue and essentially failed to adequately engage and respectfully acknowledge each others' deepest moral concerns, despite their stated commitment to do so. This essay provides a detailed critique of the two extreme views on the Council (i.e., embryos (...) have full moral status or they have none at all) and then gives theoretical grounding for our judgment about the intermediate moral status of embryos. It also supplies an account of how to address profound moral disagreements in the public arena, especially by way of constructing a middle ground that deliberately pays sincere respect to the views of those with whom it has deep disagreements. The Greek Tradition in Republic Thought completely rewrites the standard history of republican political theory. It excavates an identifiably Greek strain of republican thought which attaches little importance to freedom as non-dependence and sees no intrinsic value in political participation. This tradition's central preoccupations are not honour and glory, but happiness and justice - defined, in Plato's terms, as the rule of the best men. This set of commitments yields as startling readiness to advocate the corrective redistribution of wealth, and (...) even the outright abolition of private property. The Greek tradition was revived in England during the early sixteenth century and was broadly influential throughout the seventeenth and eighteenth centuries. Its exponents included Sir Thomas More, James Harrington, Montesquieu and Thomas Jefferson, and it contributed significantly to the ideological underpinnings of the American Founding as well as the English Civil Wars. O presente trabalho pretende situar o conceito da amizade em Montaigne. Desse modo, da amizade nasce a justiça, porque as pessoas amam reciprocamente. Elas têm como referência a comunicação. Esta indica uma nova imagem das pessoas: a fraternidade, que promove a comunhão e partilha de ideias e experiências. A análise do texto permitirá reflexões sobre o sentido maior da amizade à luz da imagem da família, da amizade e da fraternidade.

Descartes held that practicing mathematics was important for developing the mental faculties necessary for science and a virtuous life. Otherwise, he maintained that the proper uses of mathematics were extremely limited. This article discusses his reasons which include a theory of education, the metaphysics of matter, and a psychologistic theory of deductive reasoning. It is argued that these reasons cohere with his system of philosophy.

Once common, therapeutic privilege—the practice whereby a physician withholds diagnostic or prognostic information from a patient intending to protect the patient—is now generally seen as unethical. However, instances of therapeutic privilege are common in some areas of clinical psychiatry. We describe therapeutic privilege in the context of borderline personality disorder, discuss the implications of diagnostic non-disclosure on integrated care and offer recommendations to promote diagnostic disclosure for this patient population. There are no data in this work.

: Prenatal and preconceptual testing and screening programs provide information on the basis of which people can choose to avoid the birth of children likely to face disabilities. Some disabilities advocates have objected to such programs and to the decisions made within them, on the grounds that measures taken to avoid the birth of children with disabilities have an "expressive force" that conveys messages disrespectful to people with disabilities. Assessing such a claim requires careful attention to general considerations relating meaning, (...) intention, and social practices; it has only begun to receive such attention. Building on work by Allen Buchanan, who has challenged this claim, I further consider the disabilities advocates' objection, ultimately concluding that it is misplaced; neither individual actions nor general practices of this type necessarily express disrespectful messages. Like biological species, languages change over time. As noted by Darwin, there are many parallels between language evolution and biological evolution. Insights into these parallels have also undergone change in the past 150 years. Just like genes, words change over time, and language evolution can be likened to genome evolution accordingly, but what kind of evolution? There are fundamental differences between eukaryotic and prokaryotic evolution. In the former, natural variation entails the gradual accumulation of minor mutations in alleles. In the (...) latter, lateral gene transfer is an integral mechanism of natural variation. The study of language evolution using biological methods has attracted much interest of late, most approaches focusing on language tree construction. These approaches may underestimate the important role that borrowing plays in language evolution. In lieu of an abstract, here is a brief excerpt of the content:347 THE ROLE OF PART XII IN HUME'S DIALOGUES CONCERNING NATURAL RELIGION Anyone appreciative of Hume's greatness as a philosopher will want to suppose that the Dialogues both form a coherent whole and express Hume's own views on natural religion or religion based on reason (as opposed to religion based on revelation). In the last connection, given what we know of Hume's epistemology, life, and correspondence, one would be (...) inclined to suppose that he would reject out of hand the claims of revealed religion and contend that if there existed an acceptable religion it would have to be some form of natural religion. But insofar as natural religion claimed to establish scientifically the existence and nature of God one would envisage Hume dissenting. Now as long as we restrict our gaze to Parts I-XI of the Dialogues we seem to be able, easily enough, to satisfy all these suppositions. In Part IV, under the name of 'mysticism, ' revealed religion is summarily and facetiously dismissed as 2 indistinguishable from atheism. Demea's apparently permanent departure from the discussion at the conclusion of Part XI as much as says, symbolically, that revealed religion is not a serious contender for one's belief. Its a priori arguments -- the argument from sufficient reason and the ontological argument -- are almost as shortly attacked and dismissed (D 188-192). Also quite in keeping with Hume's philosophical view on knowledge of matters of fact is, on the other hand, the lengthy and detailed examination he bestows on the empiricist argument from design. That Philo, ostensibly his spokesman, is however able to uncover all kinds of logical short-comings in its claims to scientifically 348 establish the existence and nature of God does not surprise us; it coheres perfectly with our preconceived picture of Hume the skeptic, and his system as restricting science to numbers and quantities or, in the term's looser sense, to human nature and its more immediate surroundings. In short, Parts I-XI seem to be all of one Humean whole. But at first and even second glance Part XII notoriously seems to tear our hopes to find coherence and a plausible representation of Hume to tatters. There are, for one thing, those mocking sentences that seem to paint Hume in the colors of a devout, believing Christian, 'avid' for revelation. Thus, at the end of Part XII, apparently expressing Hume's deepest convictions, Philo says that "a person, seasoned with a just sense of the imperfections of natural reason, will fly to revealed truth with the greatest avidity" and immediately afterwards, "To be a philosophical sceptic is, in a man of letters, the first and most essential step towards being a sound, believing Christian" (D 227, 228). For another thing, in Part XII Hume seems to be completely reversing his refutations in Parts I-XI of the argument from design's claims to establish the existence and nature of God. Thus, where in Part II he had Philo reject the use of causal reasoning in the establishment of a Mind as the first cause of the universe on the relevantly Humean grounds that, to do so, "it were requisite, that we had experience of the origin of worlds" (D 150), in Part XII he has Philo, apparently speaking for himself (Hume), argue that "as there are also considerable differences, we have reason to suppose a proportional difference in the causes; and in particular ought to attribute a much higher degree of power and energy to the supreme cause than any we have ever observed in mankind. 349 Here then the existence of a DEITY is plainly ascertained by reason" (D 217). Indeed, all forms of the argument of design, purely analogical as well as causal, seem resurrected in Part XII, although they were one and all hanged and buried in Parts I-XI. Moreover, it seems that in Part XII Hume via Philo is saying that science itself leads us "to acknowledge a first intelligent Author" (D 214-215). I begin by asking the meta-epistemological question, 'What is justification?', analogous to the meta-ethical question, 'What is rightness?' I introduce the possibility of non-cognitivist, naturalist, non-naturalist, and eliminativist answers in meta-epistemology,corresponding to those in meta-ethics. I devote special attention to the naturalistic hypothesis that epistemic justification is identical to probability, showing its antecedent plausibility. I argue that despite this plausibility, justification cannot be identical with probability, under the standard interpretation of the probability calculus, for the simple reason that justification can (...) increase indefinitely but probability cannot. I then propose an alternative model for prima facie justification, based on an analogy with Ross's account of prima facie obligation, arguing that this model illuminates the differences between justification and probability and, given the plausible assumption of epistemic pluralism, explains them as well. Although the words “nature” and “ecology” have to be qualified in discussing either Daoism or Heidegger, the author argues that a different and potentially helpful approach to questions of nature, ecology, and environmental ethics can be articulated from the works of Martin Heidegger and the early Daoist philosophers Laozi (Lao-Tzu) and Zhuangzi (Chuang-Tzu). Despite very different cultural contexts and philosophical strategies, they bring into play the spontaneity and event-character of nature while unfolding a sense of how to be responsive to (...) the world through a practice of “non-coercive-activity” (wuwei) and “letting be” (Gelassenheit). Significant ecological implications can be drawn from the recognition of nature reinterpreted as dao (way) and as Sein (being). The openness and receptiveness of experiencing the world as being-under-way suggests what might be called a “pluralistic holism,” involving the recognition of both the interconnectedness and the unique singularity of things, and the possibility of being responsive to the phenomena themselves in their mutuality as wellas in their particular givenness. Van Fraassen argues that explanatory power cannot be a conformational virtue. In this paper I will show that informational features of scientific theories can be positively relevant to their levels of conformation. Thus, in the cases where the explanatory power of a theory is tied to an informational feature of the theory, it can still be the case that the explanatory power of the theory is positively relevant to its level of confirmation.
